1.1 Bookings and Reservations: We offer travel and tour services in Uganda and around the world. By using our services, you acknowledge that we act as a tour operator and intermediary between you and the suppliers (e.g., hotels, airlines) and that the terms and conditions of the suppliers will apply to your bookings and reservations.

1.2 Pricing and Payment: Prices displayed on our website or provided to you are subject to change without notice. We strive to provide accurate and up-to-date pricing information, but errors may occur. In the event of an error in the pricing, we reserve the right to correct it and provide you with the accurate price before proceeding with the booking. Payments for our services are typically made in advance and are subject to our payment policies.

1.3 Travel Itineraries: We will provide you with a detailed itinerary for your tour, including information on accommodations, transportation, activities, and any other relevant details. Please review the itinerary carefully, and inform us of any discrepancies or changes you would like to make.

2. User Responsibilities

2.1 Eligibility: By using our services, you represent that you are at least 18 years of age or have the legal capacity to enter into a binding agreement. If you are using our services on behalf of a company or organization, you represent that you have the authority to bind the company or organization to these Terms.

2.2 Travel Requirements: It is your responsibility to ensure that you have the necessary travel documentation, including passports, visas, and health certificates, required for your trip. We are not liable for any loss, inconvenience, or expenses incurred due to your failure to obtain or comply with the necessary documentation.

2.3 Health: You are responsible for assessing and addressing any health concerns related to your travel. We recommend that you consult with healthcare professionals and relevant authorities regarding vaccinations, and any specific health or safety precautions for your chosen destination. However, we shall ensure that we also equip you with all necessary information regarding health and travel advisories at the time of your travel. If required, rescheduling can be considered.Ā 

2.4 Code of Conduct: During your travel, you are expected to adhere to local laws, customs, and regulations. Any behavior that is illegal, disruptive, or disrespectful to others may result in the termination of our services without refund, and you may be liable for any resulting costs or damages.

3. Cancellations, Changes, and Refunds

3.1 Cancellation by You: If you need to cancel your booking, you must notify us in writing as soon as possible. Cancellation fees may apply, and the amount refunded will depend on the cancellation policies of the suppliers involved. We will provide you with the applicable cancellation terms and any refund options available to you.

3.2 Changes by You: If you wish to make changes to your booking, such as modifying travel dates, accommodations, or activities, please inform us in writing. We will make every effort to accommodate your requests, but changes may be subject to availability and the policies of the suppliers. Additional charges may or may not apply for any changes made.

3.3 Changes or Cancellations by Us: In some cases, we may need to modify or cancel your booking due to circumstances beyond our control, such as natural disasters, civil unrest, or changes in the availability of suppliers. If such changes or cancellations occur, we will notify you as soon as possible and provide alternative options or a refund, as applicable.

3.4 Refunds: Refunds, if applicable, will be processed according to our refund policies and the terms and conditions of the travel suppliers. Please note that certain costs, such as non-refundable deposits or fees, may be deducted from the refund amount.

4. Limitation of Liability

4.1 Disclaimer of Warranties: We provide our services on an “as is” and “as available” basis without any warranties or representations, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components.

4.2 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of our services, including but not limited to lost profits, loss of data, or loss of business opportunities.

5. Indemnification

You agree to indemnify and hold harmless Avella Sights (U) Ltd and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of our services or any violation of these Terms.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Uganda. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Uganda.

7. Modifications to the Terms

We reserve the right to modify or update these Terms at any time. Any changes to these Terms will be effective immediately upon posting on our website. Your continued use of our services after the modifications signify your acceptance of the revised Terms.
